Attached is the Notice to Recall Judge Kirwan, SUPERIOR COURT OF CALIFORNIA, COUNTY OF SANTA CLARA.
The California Constitution provides for the voters to recall in elected official in the state. In the case of the judges in Santa Clara County, even though they are supposed to be elected, they are all appointed to office the first time to fill a vacancy mid-term in a six year term of office, and then run unopposed for every election thereafter. When they run unopposed, they are merely sworn into office, and neither their name nor the judicial office is published on the ballot. The judges in Santa Clara County go entire careers without having to face an election, even though the office is an elective office, and non-partisan. The office has been turned into a partisan office, by the judges who have a sweetheart deal to set aside mid-term, so that the governor of their party can appoint a judge from their political party, and then they have the equivalent of a job and all the bribes they can collect, for the rest of their lives, because no one will run against them.
100 percent of the judges in Santa Clara County are bribed, and all of them have a conflict of interest in hearing cases involving any bank, a debt collector, the county, any licensed business in the county, real property, traffic tickets, child custody and child support. The judges and commissioners never disclose their conflicts of interest, and never give motions for objection to judge for disqualification for cause to a neutral judge for hearing, as required by the recusal statutes. They are uniformly dishonest, bribed and bad in Santa Clara County.
