When, on Thursday, May 5, 2016 I instructed the Bailiff, outside the Grand Jury meeting room, to deliver my paperwork to the GJ Foreman, which she assured me she would do, you stepped in and prevented that from happening. The first thing that came to my mind is by what authority did you do that? Please cite whatever O.C.G.A. code or rule you are using because even Judge McGarity didn’t know that and deferred to you.
Next, your reason for the obstruction was that this was a Clayton County matter.
Since you have no idea what the implications for Henry County are, in this matter, how could you make that determination?
Your thoughts on this are, in fact, irrelevant. It is not up to you to see what is placed before this GJ, at least not in this case. We at the Patrick Henry Board of Review could speculate many things relating to this but there is no time for such mental exercises. We have a job to do, as do you. Yours is to prosecute crime. Ours is to uncover and then present matters of crime to the only remaining source we have for true redress, the GJ.
Bill Toney was somewhat surprised by your action having been brought before them (the Henry County GJ) in the past. He spoke highly of you so let me try this one more time. Make time for me at the next GJ meeting on this coming Thursday. If that is your wish. You now know it is ours.
Remember this Jim, we at the PHBR are a dedicated and persistent lot and with every fiber of our being, believe in what we are doing. We have, within our organization, the advice of a Former Judge and former Police Chief Paul Nally along with legal researchers who are all convinced that what is going to be presented will, at the end of our meeting with the GJ, result in positive action, the likes of which you may never have seen in your time as a DA.
A tally is being kept on who and how this denial of service is being perpetrated by and this issue will be revisited after the goal at hand is achieved and you can believe me when I say, it will be achieved. You do realize that once we have been denied access to the primary GJ, any GJ in the State can hear and take action on this so do yourself and the PHBR a great big favor and lay off the obstruction.
Have a little faith that what will be presented is anything but frivolous.
