Maria is the founder of The Statewide Teleconference, First Saturday Coffee Clatch and the Interior Alaska Conservative Coalition (IACC).  The Statewide Teleconference is an effort to foster a conversation among Alaskans on a weekly basis focusing on issues important to the people of Alaska.  Its goal is restoration of the rule of law.  The First Saturday Coffee Clatch is a group that meets in Fairbanks once a month over coffee and pie to promote activism on local, state and federal issues.  The Interior Alaska Conservative Coalition is a coalition of member organizations to energize and promote good public policy, liberty and Constitutional rule of law.

Maria Rensel is the mother of three brilliant children, an entrepreneur and an activist in Fairbanks, Alaska where she lives with her husband Bill and daughter.

The three most successful businesses she’s invented include a weekly home cleaning service, a faux finish paint design company and the Gold Digger Dogs Hot Dog stand at the Tanana Valley Farmer’s Market in Fairbanks.  Gold Digger Dogs features Buffalo, Reindeer and Elk Hot Dogs piled high with pan-seared green peppers and onions and any other topping your heart desires!  Maria sold her hot dog stand last spring but it continues to operate at the Market under a new owner, with the same menu.

Subject: Encouraging News For Schaeffer Cox

Last week I wrote to a small group of you to let you know we’ve had some very encouraging news about Schaeffer’s appeal and I said that I would follow up this week with more information.  I spent last week speaking with and writing to many of you and our list has grown in numbers.  So to review last week’s letter:

Fairbanks attorney Robert John is willing to replace the current public defender working on Schaeffer’s appeal.  Robert John (RJ) truly has Schaeffer’s best interests at heart.  He lives here in the Interior and like many of us saw the situation unfold first hand.  RJ successfully defended Schaeffer on charges brought by the State of Alaska and is the best person to help with the appeal.  While he was on vacation he visited Schaeffer in Marion.  A few days ago I spoke to RJ who said that he believes that Suzanne Elliott is a good attorney but that he agrees her appeal is disappointing.  You can see an article that appeared in Alaska Dispatch on December 26, 2013 that illustrates the point here.

In order to retain RJ we’ve got to raise funds for the work he has done as well as make an effort to fund to cost of the appeal.  If necessary, RJ will replace Ms. Elliott and work on the appeal as the public defender being paid by the Federal Government.  In order to accomplish all of this, we’ve been working on several ways for people to donate to Schaeffer’s legal defense.  A friend of Schaeffer’s has created acrowd-funding campaign at the following link:

The following is a typewritten note that I received from Schaeffer:

“OK this is how the appeal works;

“After trial you have what’s called a “direct appeal”.  A three judge panel from the 9th circuit will review whatever Suzanne Elliott (my attorney) submits to them.  In this first run up through the 9th circuit they will ONLY review what was made part of the “official record” via pretrial motions or properly introduced exhibits during the actual trial.  This is not all the evidence we HAVE it is only the evidence we PRESENTED, which is a big difference in this case.  This “direct appeal” will consider everything from whether there was even enough evidence from the Government for the judge to let it go before a jury at all, to whether the judge should have granted the pretrial motions he denied, or if he messed up the jury instructions.  It focuses mostly on whether or not the process was properly followed and presumes my GUILT all the while.  Also anything that is a dispute of facts (as opposed to procedure) is viewed “in the light most favorable to the government”.  This is where Nelson Traverso really dropped the ball by not making all the proof of my innocence, which we do in fact have, part of the record during trial.  If he had I probably would have been acquitted by the jury after they saw it.  Peter Camiel did all he could to clean up after Nelson by making a lot of that evidence part of the record at sentencing and Robert John did some I his pretrial motion.  Let’s hope it is enough for Suzanne Elliott to win the direct appeal.”

“If we lose the ‘direct appeal” we can move on to what’s called a 2255 motion or a “Habeas writ”.  This goes back to the trial judge we had before (not the three judge appellate panel in the 9th circuit).  In the 2255 we can argue that there is evidence that wasn’t introduced at trial that should have been AND that it would likely have changed the outcome and thus we should be granted a new trial or some other relief.  If this 2255 motion is denied we can appeal that denial to the 9th circuit.  The trouble is that I’m not guaranteed a court appointed attorney for the 2255.  I can do it myself from prison but the judge gets so many frivolous filings from prisoners that they almost always just rubber stamp it denied.  If it can be shown that the 2255 has merit the judge will usually appoint an attorney at that point.  If we lose on the direct we will need to get an attorney who will write a show of cause and request for appointed counsel.  I don’t know how much that may cost.”

Where Schaeffer is being held:

Communication Management Unit

Although the facility no longer operates as a “supermax” facility, USP Marion is now home to one of two “Communication Management Units” in the federal prison system. The Federal Bureau of Prisons created the Communication Management Unit (CMU) in response to criticism that it had not been adequately monitoring the communications of prisoners. “By concentrating resources in this fashion, it will greatly enhance the agency’s capabilities for language translation, content analysis and intelligence sharing,” according to the Bureau’s summary of the CMU. [9][10] The other is at the Federal Correctional Complex, Terre Haute, Indiana. The units severely restrict the visitation rights for inmates and monitor all telephone calls and mail. Most of the inmates are Arab Muslims convicted of terrorism-related charges.

An ACLU lawsuit charges that CMUs of the federal prisons violates inmates’ rights. [11] In a Democracy Now interview on June 25, 2009, animal rights activist Andrew Stepanian talks about being jailed at the CMU. Stepanian is believed to be the first prisoner released from a CMU. [12]
